Businessman told to pay council tax after care company liquidated

A businessman has been ordered to pay unpaid council tax after he claimed Shropshire Council owed his company nearly £200,000.

David Fensome appeared at Telford Magistrates Court to oppose the application for a council tax liability order by Shropshire Council.

Mr Fensome claimed the council owed his former company, Telford-based Tailored Care Limited, £190,444.69 before it went into liquidation earlier this year.

Tailored Care Limited was based at Coalport House in Stafford Park

Ms Sue Jones, representing Shropshire Council in court, made an application to grant a liability order for recovery of council tax for the property in Friars Street

Mr Fensome, of Friars Street, Bridgnorth, said: “I am fully aware of how council tax works and I have no issue with the bill.

"Shropshire Council owe me through my limited company, Tailored Care Limited, £190,444.69.

"We provided a service that the council used.

"On January 2, my company was put into liquidation by directors after the bank withdrew monetary support – a very large factor of that was the debt owed by the council.

“There had been difficulties, I have had no wages since October.

"When it was clear that my company was going into liquidation, I cancelled the council tax direct debit.”

Ms Jones requested a council tax liability order for an outstanding £278.

Chairman of the magistrates, James Kiernan, granted the order.

In response to Mr Fensome’s claims, Andy Begley, a Shropshire Council director, said: “Shropshire Council contracted domiciliary care services from Tailored Care Limited until December 3, 2017.

“The directors of Tailored Care chose to sell their business in Shropshire to Kensington Community Care, and Shropshire Council supported the transfer so that staff were able to move to the new company and we were able to ensure continuity of care for service users.

"At the time of the sale, all outstanding invoices to Tailored Care Limited were paid.”
